 H-1B Cap Petitions and Fedex Delivery Errors!

Not so good news for all of us who have recently filed our H-1B applications but hope it will not create a problem!

The AILA has confirmed that the Federal Express failed to scan some of the deliveries to the agency and the employers are unable to confirm filing of their cap petitions. This is currently creating a panic in the immigrant community. According to the report, AILA has initiated a process and a close contact with the USCIS to find a solution. In the meantime, people are advised that the employers who are victims of the unfortunate events may not want to refile the petitions since they may face denials of both petitions as duplicate filings by the same employer for the same employee. This is a very unfortunate and shocking event that has developed beyond the imagination of any reasonable persons, but people should not panic. They should rather follow closely the news on the agncy's response to the unfortunate event.
