Hi..

Currently I am on h1b and have a family based F2b petition on file. My priority date is Jan 2008 (they are processing now for Mar 2006).

 

My Question is, if i choose to quit employment on h1b, or get terminated now and thus choose to go to Nepal till my priority date of Jan 2008, will I still get my GC? My parents will maintain their GC of course. Is it necessary for me to maintain my US status till I get my GC through F2b?

AFAIK

if you go Nepal, you will be fine. Your priority date will remain.
In fact gc/citizen can sponsor gc for someone who is Nepal too.
You will have to go through embassy interview for gc stamping once your priority date is current.

But if you stay in US, you will need to maintain status.

You can always call USCIS to confirm.
