Hi all,
I am currently on H4 with TPS/EAD. I have never used my EAD so far, but now that I just graduated, I am planning to start applying for the job. However, I am still confused about using my EAD, whether it will terminate my H4 status or not?

I looked over the Internet and found very conflicting answers. These are some answers I found:

1) If I use my TPS/EAD, it will violate the H4 criteria that will automatically terminate the H4 and transfer the status to TPS. So if TPS is not renewed I need to go back to Nepal and reapply H4.

2) OR I might not even need to go back to Nepal. It can reapply from here the US itself.

3) It won't affect my H4, as I am in TPS. So I can work in TPS/EAD until its valid. If it is not renewed, then it will automatically revert my status to H4, as long as my H1B sponsor maintain the status.

I am pretty sure some of you might have had this problem. If anyone can shed light over it, I would be very grateful.

Thanks.

sandyzman,
I think answer no 1 is correct.

If you just graduated, should you not be on F-1?

SIRAK,
YOu can attend college in H4 status and few other status. Doesn't have to be in F-1.

Thanks, Stupida. That answered most of my queries. Yes, I was in H4 and you do not have to be in F1 to attend your school.
